TERMS AND CONDITIONS OF TRADE

1. General

1.1 These Terms and Conditions govern the supply of products by Kora Kitchens Pty Ltd ABN 74 650 413 077 (“Kora Kitchens”, “we”, “us”, “our”) to the customer (“you”, “your”).

1.2 By accepting a quote, paying a deposit, or placing an order with Kora Kitchens, you agree to these Terms and Conditions.

1.3 Unless expressly stated otherwise in writing, Kora Kitchens supplies flat pack kitchen cabinetry only. Kora Kitchens does not provide delivery, installation, appliance installation, plumbing, electrical work, benchtops, or trade services.

1.4 Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot be excluded.

2. Quotes and Orders

2.1 Quotes are based on the plans, sketches, dimensions, selections, and other information provided by you.

2.2 All quoted prices are GST inclusive, unless expressly stated otherwise in writing.

2.3 Quotes are valid for the period stated in the quote, or if no period is stated, for 30 days from the date of issue, unless stock is sold out earlier.

2.4 A deposit equal to 50% of the quoted price secures your order and protects the quoted price for 30 days, unless otherwise stated in writing.

2.5 Orders are not confirmed until the required deposit has been received.

2.6 Final payment must be received in full before the goods leave Kora Kitchens’ premises.

3. Stock Availability and Lead Times

3.1 Lead times provided by Kora Kitchens are estimates only and may change due to workload, supplier timing, stock availability, or other circumstances beyond our reasonable control.

3.2 If stock becomes unavailable or a quoted item cannot be supplied as originally quoted, Kora Kitchens may offer an alternative product, revised lead time, or revised quote.

3.3 Kora Kitchens is not liable for delay where the delay arises from matters outside our reasonable control.

4. Order Changes and Cancellations

4.1 Any change to an order, including dimensions, specifications, finishes, quantities, or cabinet selections, must be requested in writing.

4.2 Kora Kitchens may accept or reject a requested variation at its discretion.

4.3 If a variation is accepted, the price, lead time, and availability may change.

4.4 Deposits are non-refundable once Kora Kitchens has commenced processing, ordering, reserving stock, or preparing the order, except to the extent required by law.

5. Design, Drawings and Suitability

5.1 Drawings, plans, sketches, elevations, and layouts provided by Kora Kitchens are visual representations only.

5.2 It is your responsibility to check and confirm that all products ordered, including sizes, quantities, configuration, location, and suitability, are correct for your intended use and site conditions before ordering.

5.3 Kora Kitchens does not warrant that any design, drawing, or layout complies with building, plumbing, electrical, appliance, or other regulatory requirements. You are responsible for obtaining any professional advice required for your project.

5.4 You are responsible for verifying all site measurements before placing an order.

6. Warehouse Collection

6.1 Goods will be available for collection once full payment has been received.

6.2 Collection is from:

6.3 Collection must occur during advised business hours or by prior arrangement.

6.4 You are responsible for ensuring your vehicle, trailer, tie-downs, and transport method are suitable for safe collection and transport of the goods.

6.5 If you arrange your own carrier, courier, removalist, or other transport provider, that provider acts on your behalf.

7. Risk and Title

7.1 Risk in the goods passes to you upon collection from Kora Kitchens’ premises by you or your nominated carrier.

7.2 Title to the goods remains with Kora Kitchens until full payment has been received in cleared funds.

7.3 Until title passes, you must not sell, dispose of, or encumber the goods other than in the ordinary course of a completed retail sale.

8. Inspection and Claims

8.1 You must inspect the goods at the time of collection, or as soon as reasonably practicable after collection.

8.2 Any visible damage, shortage, or incorrect item should be reported to Kora Kitchens in writing as soon as possible.

8.3 To assist with prompt resolution, any claim for visible damage, shortage, or picking error should be notified within 7 days of collection.

8.4 The 7-day period in clause 8.3 is an administrative claim period only and does not limit any rights you may have under the Australian Consumer Law.

9. Appliances, Sinks, Tapware and Other Fixtures

9.1 Kora Kitchens does not install appliances, sinks, tapware, or benchtops.

9.2 It is your responsibility to ensure that all appliances, sinks, tapware, benchtops, and other fixtures are suitable for the cabinetry ordered and fit the intended space.

9.3 Kora Kitchens is not responsible for costs arising from incorrect measurements, incompatible products, third-party installation issues, or non-compliance with manufacturer requirements or applicable regulations, except to the extent required by law.

10. Flooring, Site Conditions and Installation by Others

10.1 Kora Kitchens’ cabinetry is designed around a standard 150mm toe-kick unless otherwise stated.

10.2 If cabinetry is installed before flooring, or if finished floor levels differ from those assumed, adjustments may be required by your installer.

10.3 Kora Kitchens is not responsible for installation issues arising from site conditions, out-of-square walls, floor levels, finished floor height, incorrect site measurement, or installation by others, except to the extent required by law.

11. Warranty Against Defects

11.1 Kora Kitchens provides a 7-year warranty on cabinets and hardware against defects in materials and workmanship, subject to these Terms.

11.2 This warranty does not cover damage caused by:

a. improper transport, handling, storage, or unloading after collection;
b. incorrect or careless installation;
c. misuse, neglect, abuse, or accident;
d. water ingress, excessive moisture, exposure to weather, or outdoor use;
e. prolonged or repeated direct sunlight;
f. normal wear and tear;
g. movement caused by structural issues, site conditions, or building movement;
h. damage to finishes caused after collection, including scratches, chips, dents, impact damage, or abrasion.

11.3 To make a warranty claim, you must notify Kora Kitchens in writing with:

a. your name and contact details;
b. proof of purchase;
c. details of the alleged defect; and
d. photographs where reasonably available.

11.4 Kora Kitchens may inspect the goods, request return of the affected component, or request further information before determining the claim.

11.5 Where a valid warranty claim is accepted, Kora Kitchens will provide a remedy in accordance with the Australian Consumer Law and this warranty.

11.6 This warranty is provided in addition to your rights under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

12. Limitation of Liability

12.1 To the extent permitted by law, Kora Kitchens is not liable for indirect, special, or consequential loss, including loss of profit, loss of opportunity, delay costs, or third-party contractor costs, arising out of the supply of goods.

12.2 Where liability cannot be excluded, Kora Kitchens’ liability is limited to the remedies available under the Australian Consumer Law or other applicable law.

12.3 Kora Kitchens is not responsible for work performed by third parties, including installers, trades, transport providers, stonemasons, or appliance suppliers engaged by you.

13. Intellectual Property

13.1 All drawings, plans, sketches, layouts, and other design material prepared by Kora Kitchens remain the intellectual property of Kora Kitchens unless otherwise agreed in writing.

13.2 You must not reproduce, distribute, or use Kora Kitchens’ drawings or design material for commercial purposes without our prior written consent.

14. General

14.1 You may not assign or transfer your rights or obligations under these Terms without Kora Kitchens’ prior written consent.

14.2 If Kora Kitchens does not enforce a right under these Terms, that does not amount to a waiver of that right.

14.3 If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remainder will continue in full force and effect.

14.4 These Terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
